Our Pledge to You
Smile Brite Dental is required by the Health Insurance Portability and Accountability Act ("HIPAA") to maintain the privacy of your protected health information ("PHI"), to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect.
How We May Use and Disclose Your PHI
We may use and disclose your PHI without your written authorization for:
- Treatment — coordinating dental care, sharing information with referring providers, labs, and specialists.
- Payment — billing, insurance verification, eligibility checks, and collection activities.
- Healthcare Operations — quality assessment, training, credentialing, scheduling, and practice management.
- Appointment Reminders — contacting you by phone, text, email, or mail.
- Treatment Alternatives & Health-Related Benefits — informing you about services we offer.
- Required by Law — public health activities, abuse reporting, judicial proceedings, law enforcement, and other uses required by federal, state, or local law.
- Business Associates — entities that perform services on our behalf under written agreement to safeguard your PHI.
Other uses or disclosures, including most uses for marketing, sale of PHI, and psychotherapy notes, require your written authorization. You may revoke any authorization in writing at any time, except to the extent we have already acted in reliance on it.
Your Rights Regarding Your PHI
- Right to Inspect and Copy — request access to your dental records.
- Right to Amend — request a correction if you believe your record is inaccurate or incomplete.
- Right to an Accounting of Disclosures — request a list of certain disclosures we have made.
- Right to Request Restrictions — request limits on how we use or disclose your PHI; we will accommodate reasonable requests where required by law.
- Right to Confidential Communications — request that we contact you at a specific phone number or address.
- Right to a Paper Copy of This Notice — even if you previously agreed to receive it electronically.
- Right to Be Notified of a Breach — we will notify you in the event of a breach of your unsecured PHI.
Our Responsibilities
- We are required to maintain the privacy and security of your PHI.
- We will provide you with this Notice of our legal duties and privacy practices.
- We will follow the terms of the Notice currently in effect.
- We will not use or share your information other than as described here unless you tell us in writing that we may.
Changes to This Notice
We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have about you, as well as any information we receive in the future. A current copy will be posted in our office and on this Site.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer using the contact information below, or with the Secretary of the U.S. Department of Health and Human Services at hhs.gov/ocr. You will not be retaliated against for filing a complaint.
